Changes in orders issued by Chandigarh Housing Board

Keeping in view the persistent demand of the general public and in the interest of public service, the Chandigarh Housing Board had issued Order no. 160 dt. 24/06/2016 for the transfer cases where the applicant (purchaser) has fulfilled all requirements of the GPA Policy except the proper linkage of Agreement to sell from the Allottee to the applicant/purchaser, and ordered that such cases shall be regularized under the GPA policy of CHB subject to the fulfilment of following conditions:

  1. In addition to the other formalities/requirements of the GPA policy, the applicant has to give a surety for the transfer,
  2. The department will give additional publications in three newspapers besides publication in the usual three newspapers.
  3. The department will charge 5% additional transfer fee in such cases,
  4. The department will allow transfer with a condition that if any sort of objection regarding the transfer is received, then the transfer shall be cancelled.

Similarly the Chandigarh Housing Board has issued Order no. 185 dated 12/07/2016 for the transfer cases where the Agreement to Sell which was part of the GPA transaction was not available/lost and ordered that  the department shall regularize these cases if: –

  1. The applicant submits the proof of loss of agreement to sell i.e. DDR & non-traceable report and,
  2. The secondary evidences i.e. proof of the existence/ contents of Agreement to Sell as well as proof of payment.

If the applicant has no photocopy or other supporting proof, then anyone of the witnesses of the lost agreement may give his statement by way of an affidavit stating the contents of the lost agreement to sell.

  1. The department shall charge 3% additional transfer fee in such cases,
  2. In addition to the other formalities/requirements of the GPA policy, the applicant has to give a surety for the transfer,
  3. The department shall give additional publications in three newspapers besides publication in the usual three newspapers.
  4. The department shall allow transfer with a condition that if any objection(s) regarding the transfer is received, then the transfer shall be cancelled.

In these orders, there is a condition that the applicant has to give a surety for the transfer of property. During the process, it has come to notice that applicants have to face a lot of inconvenience, in order to arrange a surety.   Keeping in view these circumstances, on the persistent demand of the general public and in the interest of public service, it is hereby ordered that there is no longer a requirement to give a surety for transfer under these orders.
